Browsing and transmitting a purchase order on the website implies acceptance of the Terms and Conditions and Data Protection Policies adopted by the website and indicated therein.
1.2. These General Terms and Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the website in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/05 amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03) by

1.3. Before accessing the products provided by the website, the user is required to read these General Terms and Conditions of Sale, which are understood to be generally and unequivocally accepted at the time of purchase.
1.4. Users are invited to download and print a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which www.giorgiopioladesign.com reserves the right to modify unilaterally and without prior notice.

Article 2 – Subject matter
2.1. These General Terms and Conditions of Sale govern the offer, transmission and acceptance of purchase orders for products on www.giorgiopioladesign.com and do not govern the provision of services or the sale of products by parties other than the seller who are present on the same website via links, banners or other hypertext links.
2.2. Before placing orders and purchasing products and services from different parties, we recommend that you check their terms and conditions of sale.
Article 3 – Conclusion of the contract
3.1. To conclude the purchase contract, you must complete the electronic form and submit it following the relevant instructions.
3.2. It contains a reference to the General Terms and Conditions of Sale, images of each product and its price, the means of payment that can be used, the methods of delivery of the products purchased and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and the methods and times for returning the products purchased.
3.3. Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.
3.4. The contract is concluded when the seller receives the form completed by the user, after verifying the correctness of the data contained therein.
3.5. The user shall be obliged to pay the price from the moment the online order submission procedure is completed. This shall be done by clicking on the place order button at the end of the guided procedure.
3.6. Once the contract has been concluded, the seller will take charge of the order for its fulfilment.
Art. 4 – Registered users
4.1. When completing the registration procedures, the user undertakes to follow the instructions on the website and to provide their personal data in a correct and truthful manner.
4.2. Once registration is complete, the user will receive a confirmation email at the address provided. Confirmation must be sent within one day at the latest. After this period, if no confirmation has been received, www.giorgiopioladesign.com will be released from any obligation towards the user.
4.3. The confirmation shall in any case exempt www.giorgiopioladesign.com from any responsibility regarding the data provided by the user. The user undertakes to promptly inform www.giorgiopioladesign.com of any changes to their data communicated at any time.
4.4. If the user provides inaccurate or incomplete data, or if there is a dispute by the parties concerned regarding the payments made, www.giorgiopioladesign.com shall have the right not to activate or to suspend the service until the relevant shortcomings have been remedied.
4.5. When the user first requests activation of a profile, www.giorgiopioladesign.com will assign them a username and password. The user acknowledges that these identifiers constitute the system for validating user access to the Services and the only system suitable for identifying the user, that the actions performed through such access will be attributed to them and will be binding on them.
4.6. The user undertakes to keep their access data confidential and to store them with due care and diligence and not to disclose them to third parties, even temporarily.
Art. 5 – Product availability
5.1. Product availability refers to actual availability at the time the user places the order. However, this availability must be considered purely indicative because, due to the simultaneous presence of multiple users on the website, products may be sold to other customers before the order is confirmed.
5.2. Even after the order confirmation email has been sent, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected by removing the unavailable product and the user will be immediately informed by email.
5.3. If the user requests cancellation of the order, thereby terminating the contract, www.giorgiopioladesign.com will refund the amount paid within 7 working days from the moment www.giorgiopioladesign.com became aware of the purchaser’s decision to terminate the contract.

Art. 7 – Payment methods and prices
7.1. The price of the products will be as indicated on the website from time to time, except where there is an obvious error.
7.2. In the event of an error, www.giorgiopioladesign.com will notify the purchaser as soon as possible, allowing them to confirm the order at the correct amount or cancel it. In any case, www.giorgiopioladesign.com will not be obliged to supply the goods sold at the lower price incorrectly indicated.
7.3. The prices on the website include VAT. Prices are subject to change at any time. Changes do not affect orders for which an order confirmation has already been sent.
7.4. Shipping costs will be paid separately by the user and will vary depending on the user’s shopping cart. The user will always be informed of the shipping costs at the time of checkout.
7.5. Once you have selected the desired products and services, they will be added to your shopping cart. Simply follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details can be modified before payment.
7.6. Payment can be made by credit/debit card. Payment details must be entered at the time of ordering using either a valid credit card or debit card, such as Visa and Mastercard (American Express is not accepted). The amount will be retained immediately, and www.giorgiopioladesign.com reserves the right to verify the validity of the card and its solvency status. Following the checks, www.giorgiopioladesign.com reserves the right to refuse the order.
7.7. In the case of payment by PayPal, www.giorgiopioladesign.com reserves the right to verify the validity of the PayPal account, to verify that there are sufficient funds to cover the purchase amount and to confirm the correctness of the buyer’s billing address details. The amount will be immediately withheld from the PayPal account, but you will not be charged until the items leave the warehouse. www.giorgiopioladesign.com reserves the right to refuse any order.

Article 8 – Delivery
8.1. www.giorgiopioladesign.com ships throughout Italy, excluding Vatican City and the Republic of San Marino.
8.2. Deliveries will be made worldwide.
8.3. www.giorgiopioladesign.com will only deliver to the user’s home address provided at the time of purchase.
8.4. Delivery within Italy is generally made within the following period: a minimum of 7 working days, or, if no delivery date is specified, within the estimated time frame indicated when selecting the delivery method and, in any case, within a maximum of thirty days from the date of confirmation.
8.5. For countries within the European Union, delivery will be made within one week and, in any case, within a maximum of thirty days.
8.6. In non-EU territories, delivery will be made within two weeks.
8.7. If delivery is not possible, the order will be sent to the warehouse. In this case, a notice will specify the location of the order and how to arrange a new delivery.
8.8. If you are unable to be present at the delivery location at the agreed time, please contact us again to arrange a new delivery date.
8.9. If delivery cannot take place for reasons beyond our control within thirty days of the date on which the order is available for delivery, we will assume that you wish to terminate the contract.
8.10. As a result of the termination, the amounts will be refunded, including delivery costs, excluding any additional costs arising from the choice of a delivery method other than the ordinary method offered, without undue delay and, in any case, within 7 working days from the date of termination of the contract. Transport resulting from the termination of the contract may incur additional costs, which will be borne by the purchaser.
8.11. Shipping costs are charged to the purchaser and are clearly indicated at the time of placing the order.
Article 9 – Transfer of risk
9.1. The risks relating to the products shall pass to the purchaser upon delivery. Ownership of the products shall be deemed to have been acquired upon receipt of full payment of all amounts due in relation to them, including shipping costs, or upon delivery, if this occurs at a later date.
Article 10 – Warranty and commercial conformity
10.1. The seller is liable for any defects in the products offered on the website, including non-conformity of the items with the products ordered, in accordance with Italian law.
10.2. If the purchaser has entered into the contract as a consumer, i.e. any natural person acting on the website for purposes unrelated to any business or professional activity, this warranty is valid provided that the defect occurs within 24 months of the date of delivery of the products; that the purchaser submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognised by the purchaser; and that the online return form is completed correctly.
10.3. In the event of non-conformity, users who have entered into the contract as consumers shall be entitled to have the products brought into conformity free of charge, either by repair or replacement, or to obtain an appropriate price reduction or termination of the contract in relation to the disputed goods and a refund of the price.
10.4. All costs of returning defective products shall be borne by the seller.
Article 11 – Withdrawal
11.1. In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without penalty and without specifying the reason, within 14 days pursuant to Article 52 of Legislative Decree 206/2005, starting from the date of receipt of the products.
11.2. In the event of multiple purchases made by the purchaser in a single order and delivered separately, the 30-day period shall commence from the date of receipt of the last product.
11.3. Users who wish to exercise their right to withdraw from the purchase may send an email, indicating the order number and user name, to: giorgio@giorgiopioladesign.com
11.4. The purchaser shall also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract or, alternatively, by submitting the standard withdrawal form, as per Annex I, part B, Legislative Decree 21/2014, which is not mandatory.

11.6. The goods must be returned intact, in their original packaging, complete in all their parts and accompanied by the relevant tax documentation. Without prejudice to the right to verify compliance with the above, the website will refund the amount of the products subject to withdrawal within a maximum of 7 working days, as well as any shipping costs incurred by the user.
11.7. The costs of returning the goods shall be borne by www.giorgiopioladesign.com.
11.8. As provided for in Article 56, paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the website may suspend the refund until the goods have been received or until the purchaser has provided proof that the goods have been returned.
11.9. The right of withdrawal shall not apply if the services and products of www.giorgiopioladesign.com are included in the categories referred to in Article 59 of Legislative Decree 206/2005.
11.10. The website will issue a refund using the same payment method chosen by the purchaser at the time of purchase. In the case of payment by bank transfer, and if the user intends to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT and BIC necessary to issue the refund.

12.1. The purchaser’s data is processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the specific section containing the information notice pursuant to Article 13 of EU Regulation 2016/679 (Privacy Policy).
Article 13 – Safeguard clause
13.1. In the event that any clause of these General Terms and Conditions of Sale is invalid for any reason, this shall in no way affect the validity and compliance with the other provisions contained in these General Terms and Conditions of Sale.

Art. 15 – Applicable law and jurisdiction
15.1. These General Terms and Conditions of Sale are governed by and interpreted in accordance with Italian law, without prejudice to any different mandatory rules prevailing in the country of habitual residence of the purchaser. Consequently, the interpretation, execution and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law.
15.2. Any disputes relating to and/or arising from the same shall be resolved exclusively by the Italian courts. In particular, if the user is a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same in accordance with applicable law.
